General Terms of Service

1. Service Content

The owner of the site provides users who intend to make use of it with a web-based service (hereinafterreferred to as the 'Basic Service' and/or 'Service') that allows the publication and consultation of ads and listings by private individuals or professionals offering and seeking services. The Service also allows advertisers and users interested in the published content to contact each other.

2. Platform Ownership

Malavasi Fabrizio, is the sole owner of the web platform through which the Service is managed, as well as all related rights pertaining to and resulting from the exploitation of the same platform.

3. Applicability of the Conditions

These General Conditions of Service apply to both users who use the Service to view published ads and private or professional advertisers (hereinafter collectively referred to as 'user(s)').

4. Terms of Use for the Service

The use of the Service is only allowed for adult users. The use of the Basic Service allows free consultation of ads, the publication of listings, and the creation of accounts for the use of the service itself. Certain specific features of the Service, including ads in certain categories, may be made available only through payment, as specified in the contract conditions related to those services. The relationships between users of the Service, the exchange of information, occur exclusively between users without the site owner being a party to the relationship. Users also agree not to misuse the contacts available on the platform. For example, but not exhaustively, sending unauthorized or unsolicited advertising, promotional material, or any other form of solicitation via email or any other contact method is prohibited. Users will retain ownership of all rights related to photographs or other material (hereinafter, the 'Reproductions') that they are allowed to publish on the site. Notwithstanding the foregoing, the user grants the site owner a non-exclusive, free, perpetual, transferable, irrevocable, and unlimited territory license to use (also in combination with other audio and/or video and/or photographic materials) and, therefore, fix, within the site and/or on any other means (whether digital, electronic, or paper), reproduce, modify, adapt, translate, distribute, publish,display, publicly reproduce the user's Reproductions, also committing not to oppose the publication, use, modification, deletion, and exploitation of the Reproductions by the owner of the web site. By using the Service, users assume exclusive responsibility for the right to use the Reproductions published by them on the site, indemnifying and holding the site owner harmless from any claim and/or request for compensation made by third parties due to the violation of their rights. Upon registration on the site, users must provide their real personal data without using temporary email addresses or aliases (i.e., addresses associated with their email address from which they cannot send emails but only receive them). It is expressly understood that, in case of non-compliance with the provisions of this clause by the user, the site owner will be considered relieved of the obligation to provide certain assistance services to the user, as it is unable to verify the correspondence between user and email.

5. The User's Responsibility

The user is entirely and exclusively responsible for the use of the Service (explicitly referring to the functions of publication, consultation, management of listings, and user contact) and is therefore the sole guarantor and responsible party for the goods and services offered through the Service, as well as the correctness, completeness, and legality of the listings and their behavior in user interactions. The user guarantees the truthfulness and/or availability/ownership of the goods/services subject to the listings. The user also guarantees that their ads do not violate any copyright, industrial property rights, or other rights of third parties. In the event of a dispute by third parties regarding any ad or conduct related to it, the user takes full responsibility and undertakes to indemnify and hold the site owner harmless from any damage, loss, or expense. The user agrees to use the ads solely for the purpose of contacting and exchanging information with other users regarding the ads, using appropriate language, in accordance with the law, ethics, and netiquette. In any case, the user agrees to respect the rules of good manners and the use of appropriate language with any interlocutor, both online and offline. The site owner reserves the right at any time to report to the competent authorities if they identify illicit, defamatory, threatening, or slanderous content in communications with their staff. Furthermore, the user assumes full responsibility for any damage that may result from the use of the Service to their computer system or that of third parties. It is also understood that any use of robots, spiders, scrapers, and/or other automatic tools to access the site and/or extract its content is expressly prohibited.

6. Limitation of Liability

The owner of the website makes no warranty regarding the content, completeness, and accuracy of the published listings, nor concerning the data published, nor with regard to information subsequently provided by the user, nor with reference to the number or quality of results obtained through the Service. In any case, the owner of the website reserves the right, at any time, to evaluate, approve, delete, or prevent the insertion or the right to inhibit consultation or contact in the event that, at its sole discretion, the user's use of the Service may be deemed to infringe upon the rights or prerogatives of the owner of the website or third parties. It is understood that even in the case of evaluation and approval of the listings (whether automatic or manual), the owner of the website makes no warranty regarding the content, completeness, and accuracy of the same.

7. Limitations in the Provision of the Service"

The owner of the website reserves the right to modify, suspend, or interrupt, in whole or in part, the Service at any time, even without notice and without being obliged to indicate the reasons underlying the aforementioned actions.

8. Serial Publication of Ads and/or on Behalf of Third Parties

It is expressly prohibited, unless explicitly authorized by the owner of the website: - the use of automatic systems for uploading advertisements; - serial publication and/or management of advertisements on behalf of third parties by any means or method; - reselling the website's services to third parties.

9. Limitations on the content of publications and information related to the user's profile"

The user undertakes not to falsify their identity and to comply with all applicable legal provisions, as well as the terms and conditions that the user accepts and acknowledges they must review before posting any advertisement or contacting another user. The user also undertakes not to use the Service for the publication, transmission, exchange of illegal, vulgar, obscene, slanderous, defamatory, offensive to current morality, or otherwise harmful material, or for messages that incite hatred and racial or religious discrimination. Furthermore, the user agrees not to use the Service in a way that violates the intellectual or industrial property rights of the site owner or third parties.

10. Validity of these General Conditions

The owner of the website may, however, unilaterally make changes to these General Conditions at any time, providing notice on their web platform.

11. Jurisdiction

The relationships between the owner of the website and the users are governed by Italian law, according to which these General Conditions must also be interpreted.

12. Modifications

These conditions may be subject to changes. In the case of substantial modifications, the owner of the site will notify the user by prominently publishing them on their pages or through email or another means of communication.
